Anglo Platinum management wishes to announce that the Labour Court has ruled on the industrial action at Precious Metals Refiners (PMR) and Rustenburg Base Metals Refiners (RBMR), which arose out of a dispute concerning a unilateral change to terms and conditions of employment.
The Labour Court has ordered that the striking employees return to work immediately in respect of RBMR, and by 14h00 on Tuesday, 16 April 2002 in respect of PMR.
The union and their members (employees of PMR and RBMR) are interdicted from inciting and/or participating in industrial action.
The court has ruled that the industrial action is unprotected. The order follows the principles established in the judgement handed down by Francis, AJ of the Labour Court on Thursday, 11 April 2002, in that the company has the right to change the provider of a medical service, but not the benefit itself, as is contained in the employees`contract of employment.

Media Release - Medical Aid dispute continues 12 April 2002
Following the judgement by the Labour Court in respect of the dispute between Rustenburg Base Metals Refiners (RBMR) and members of the National Union of Metal Workers of SA (NUMSA) and the National Union of Mine Workers (NUM), Anglo Platinum management is pleased to announce that all striking employees have returned to work this afternoon.
The Company wishes to further announce that members of the National Union of Mine Workers (NUM) at the Precious Metals Refiners (PMR) embarked on industrial action which commenced today.
Production remains unaffected at both Rustenburg Base Metals Refiners (RBMR) and Precious Metals Refiners (PMR).

Medical Aid dispute resolved 11 April 2002
Anglo Platinum management wishes to announce that the court has ordered that the Company is entitled to unilaterally change the medical scheme of all employees who signed contracts of employment after 1994. In respect of employees who signed the agreement prior to 1994, the Company is not entitled to change the medical scheme unilaterally. The Company will therefore retain the status quo in respect of employees who signed contracts of employment before 1994.
In view of these developments, the Company expects the strike by members of the National Union of Mine Workers (NUM) and the National Union of Metal Workers of SA (NUMSA) at its Rustenburg Base Metals Refiners (RBMR) to end and all striking employees to return to work at their next shift.
Management further announces that this week-long strike did not, in any way, affect production and the plant is running normally.

Anglo Platinum optimistic that medical aid dispute 03 April 2002
Anglo Platinum management wishes to advise that some members of the National Union of Mine Workers (NUM) and National Union of Metal Workers of SA (NUMSA) have embarked on a strike today at the company's Rustenburg Base Metals Refiners (RBMR). The parties reached deadlock after extensive consultations on the issue of the new medical aid scheme, which has been accepted by the majority of employees throughout the Company. The Company believes that the action is unprotected and therefore illegal, precisely because the change in the medical aid scheme did not, in any way, affect the employees' conditions of employment.
In the spirit of resolving the current impasse, management proposed to NUM and NUMSA to take the matter to mediation but both Unions rejected the proposal.
The company wishes to further state that, as a result of deteriorating medical aid benefits and subsequent escalating contributions in the medical schemes industry, management felt it necessary to introduce the said medical aid scheme after extensive consultations with all employee representatives.
The Company remains convinced that the new medical aid scheme provides better benefits at a reduced cost and that all employees are in a better position financially.
Management remains optimistic that concerns raised by both Unions can be resolved through dialogue and discussion. In the meantime, the company urges all striking employees to return to work immediately. No loss of production is expected as a result of this action as the majority of employees are working.
